1. Introduction
SwitchBlue Insurance Agency LLC ("SwitchBlue," "we," "us," or "our") is committed to protecting the privacy and security of our users and clients. As a licensed independent insurance agency, we provide educational content, plan comparison engines, and personalized consultation services related to Medicare Advantage (Part C), Medicare Prescription Drug (Part D), and Medicare Supplement (Medigap) plans.
This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit our website (switchblueinsurance.com) and request insurance quotes or information, or when you interact with our licensed insurance agents.
2. Information We Collect
We collect personal information that you voluntarily provide when requesting a quote or consultation, including your name, phone number, email address, and state of residence. To provide accurate Medicare plan evaluations, we may also collect:
- Contact Information: First name, last name, phone number, email address, and mailing address.
- Demographic Information: Date of birth, gender, and ZIP code (essential to determine plan availability in your county).
- Medicare-Specific Status: Information on whether you are turning 65, already enrolled, or currently experiencing a Special Enrollment Period (SEP).
- Healthcare Preferences (Optional): Answers to our interactive questionnaire, such as your doctor network preferences, premium priorities, and prescription drug usage frequency.
- Usage Data: IP address, browser type, operating system, and pages visited to help us optimize your experience on our website.
3. How We Use Your Information
We use the information we collect to run our agency operations and serve prospective clients in full accordance with insurance law:
- To provide custom insurance rate quotes and analyze localized plan options in your county.
- To connect you with a certified, licensed independent insurance agent.
- To contact you (via phone, text, or email) to discuss Medicare queries, schedule telephone consultations, or complete pre-enrollment questionnaires.
- To send automated appointment confirmations or policy renewal reminders.
- To verify your identity and prevent fraudulent activities.
- To comply with CMS records preservation regulations (licensed agents are required to store communication records for a minimum of 10 years).
4. CMS & HIPAA Compliance
SwitchBlue operates under strict compliance with the Centers for Medicare & Medicaid Services (CMS) and federal privacy standards.
The Health Insurance Portability and Accountability Act (HIPAA): While simple inquiry forms on our website do not constitute official medical records, any personal health information (PHI) you share with us (such as prescription drugs or medical histories) is protected in accordance with the security and privacy goals of HIPAA. We utilize secure socket layer (TLS/SSL) encryption, role-based database permissions, and secure server host environments.
CMS Recording Rules: Under current CMS rules, all phone conversations where Medicare Advantage or Part D plans are discussed must be recorded and securely archived for 10 years. Before any recorded discussion, your licensed agent will explicitly state the recording notice.
5. TCPA & Consent to Contact
In compliance with the Telephone Consumer Protection Act (TCPA) and CMS regulations, we require your explicit, affirmative consent before we send SMS messages to your mobile number. Providing a phone number on our contact form does not enroll you in texting.
Transactional SMS consent (optional checkbox #1):
"I agree to receive SMS messages from SwitchBlue Insurance Agency regarding my inquiry, information I requested, appointment reminders and confirmations, Medicare consultation updates, policy servicing, and customer support. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is not a condition of purchase. View our Privacy Policy and Terms of Service."
Marketing SMS consent (optional checkbox #2):
"I would also like to receive occasional educational Medicare information and promotional Medicare-related updates from SwitchBlue Insurance Agency. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is not required to purchase insurance. View our Privacy Policy and Terms of Service."
These optional checkboxes appear only on our contact form. They are never pre-checked. You may submit the form without checking either box and without providing a mobile number. Consent to receive texts is not required to request a consultation, get a quote, or enroll in a plan. Program details are on our SMS program page.
If your phone number is listed on a state or federal "Do Not Call" registry, your submission of our web forms acts as an official exception, granting us permission to contact you regarding your request.
